CITY OF KIRTLAND
RESOLUTION NUMBER 09-R-59

A RESOLUTION RELATING TO ESTABLISHING RULES, TIME AND PLACE OF COUNCIL MEETINGS FOR THE PERIOD FROM DECEMBER 1, 2009, THROUGH NOVEMBER 30, 2010, AND DECLARING AN EMERGENCY.

BE IT RESOLVED by the Council of the City of Kirtland, County of Lake and State of Ohio, that:

SECTION I:       Kirtland Council Rules, together with Robert's Rules of Order, will be used to govern the actions of Kirtland City Council.

SECTION II:     Kirtland City Council will meet regularly twice each month at 7:00 p.m. on the first (1st) and third (3rd) Mondays.  The only exceptions to this rule are:

Monday, January 18, 2010 (Martin Luther King, Jr. Day).  Council will meet on Wednesday, January 20, 2010.

(b)        Monday, February 15, 2010 (Presidents’ Day).  Council will meet on Wednesday, February 17, 2010.

(c)        Monday, May 3, 2010.  To accommodate the Board of Elections with regard to the set-up of voting equipment prior to the Primary Election, Council will meet on Wednesday, May 5, 2010.

(d)       To provide for Summer Recess, Council will meet on Wednesday, July 7, 2010 and Monday, July 12, 2010.   Council will meet next on the last two Mondays in August, to-wit:  August 23, 2010 and August 30, 2010.

(e)        Monday, September 6, 2010 (Labor Day).  Council will meet on Wednesday, September 8, 2010.

(f)        Monday, November 1, 2010.  To accommodate the Board of Elections with regard to the set-up of voting equipment prior to Election Day, Council will meet on Wednesday, November 3, 2010.

SECTION III:

(a)        It is found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were passed in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

(b)        This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the City, and for the further reason that it is necessary to provide for the usual and customary operations of the Council of the City of Kirtland; wherefor, this Resolution shall be in full force and effect immediately upon its passage by the affirmative vote of five (5) members of Council and approval by the Mayor, otherwise this Resolution shall be in effect from and after its adoption at the earliest period allowed by law.
